In October 2021, the Montgomery and Bucks County election boards asked the Commonwealth Court to order counties to accept and count absentee and mail-in ballots without handwritten dates on the outer return envelopes.
In December, Acting Secretary of the Commonwealth Veronica Degraffenreid agreed that a court declaration was needed to address this potential voter disenfranchisement issue.
States United served as pro bono counsel for the acting secretary and was co-counsel with Spencer Scharff of Scharff PLLC.
In January 2022, the court denied a motion to intervene filed by Republican leaders in the Pennsylvania House of Representatives and Senate.
